Common Questions / Knee Injuries
What is a knee injury case worth? ACL, meniscus, and dashboard knees
Knees are injured two ways in a crash: driven into the dashboard, the classic PCL injury, or torn by the violent brace-and-twist, ACL and meniscus. The quiet stakes are long-term, because a knee that loses meniscus or takes a joint fracture is a knee on the road to arthritis, and that road is compensable now.
Two mechanisms, one joint
The dashboard writes the first injury: a bent knee driven forward into the dash sends the shin backward and tears the posterior cruciate ligament, the classic dashboard knee, sometimes fracturing the kneecap on the way in. The second mechanism needs no contact at all, the leg braced hard on the pedal, the body twisting with the impact, and the ACL or meniscus tears exactly as it would on a football field. The symptoms map to the structures: instability and the knee that gives way for the ligaments, the locking, catching, and joint-line pain for the meniscus, swelling for everything, and an MRI sorts the anatomy. None of it should be walked off, because a knee that is unstable does not just hurt, it falls, and the second injury from a giving-way knee is a case within the case.
The meniscus decision nobody explains
Meniscus surgery sounds routine, and the arthroscopy itself often is, but the choice inside it carries decades: a repair preserves the cartilage cushion, while a meniscectomy removes the torn portion, and every millimeter of meniscus removed transfers load onto joint surfaces that will wear for the rest of the client's life. Post-traumatic arthritis after meniscus loss or joint-surface damage is among the best-documented long arcs in orthopedics, arriving years later as stiffness, pain, and, for many, an eventual knee replacement, and Texas law compensates that future now when the treating surgeon states it to a reasonable probability. An offer made at the post-arthroscopy follow-up, before anyone has priced the arthritis or the replacement, is an offer to buy the future for the cost of the scope.
The defense theme, and the working knee
The defense reads knee MRIs the way it reads every joint, degenerative fraying, wear, pre-existing, and the answer is the familiar pairing: tear patterns and acute findings that qualified physicians can date, and a before-and-after record of a knee that squatted, climbed, and worked without complaint until the crash. Value then follows the life: the tradesman on ladders, the nurse on concrete floors, the parent on the stairs at home, a knee is a working joint, and its restrictions, kneeling, climbing, squatting, uneven ground, are priced through the work they take away, alongside the hardware, the therapy months, and the futures above.
Before the scope settles the case
If your knee case is being valued as a simple arthroscopy, the largest numbers in it have not been counted. Silver Key Law prices knees on the whole arc, mechanism to arthritis, and the consultation is free.
